Relocation and community transition

Where an activity requires land, and where an activity ends, the effects on the people concerned are planned for rather than dealt with as they arise.

No relocation is under way. This page states the requirements that would govern one, and the requirements that govern social transition at closure, because both are matters on which a reader is entitled to know the standard before the situation arises rather than after.

Land acquisition and resettlement

Where an activity requires land acquisition, Performance Standard 5 of the IFC Performance Standards is applied as the reference standard. Its central requirements are stated here in the form the framework uses.

Physical and economic displacement is avoided where an alternative project design can achieve the objective. Displacement is a design outcome, not an inevitability, and the alternatives considered are recorded
Minimisation
Where displacement cannot be avoided, it is minimised in extent and in the number of people affected
Census and inventory
Affected households, assets, land uses and rights, including customary and informal rights, are identified before any acquisition, with a cut-off date established and communicated
Consultation and participation
Affected households take part in the process, including in the design of compensation and resettlement arrangements, and vulnerable households are identified and given particular attention
Compensation
Compensation is provided at full replacement cost for lost assets, paid before displacement occurs, and covers those with customary and informal rights as well as those with formal title
Livelihood restoration
Livelihoods are restored, not only assets replaced. Where land-based livelihoods are affected, land-based replacement is preferred and support continues until restoration is demonstrated
Grievance mechanism
A dedicated mechanism operates throughout the process and is accessible to all affected households
Monitoring and completion
Outcomes are monitored against the plan and against the pre-displacement baseline, with completion assessed on livelihood restoration rather than on payment being made

Involuntary resettlement and the role of the State

Land acquisition in Peru may involve State processes as well as private negotiation. Where the State conducts a process, our role is to provide the information the process requires and to participate in it, and the standards on this page continue to apply to our own conduct within it. We do not treat a State-conducted process as removing the requirements Performance Standard 5 sets.

Social transition at closure

Closure is a social event as well as a physical one. An activity that has provided employment, procurement and services to a locality changes those conditions when it ends, and the effect is concentrated on the people least able to absorb it.

Employees and contractors affected by closure are given notice, support and, where practicable, redeployment or retraining

Records

Land, resettlement and transition arrangements generate commitments, and those commitments enter the commitments register with an owner and a date. We retain compensation, consultation and monitoring records, because the effects of a resettlement are assessed over years and the record has to outlive the people who made it.

Reporting

Where a relocation takes place, it is reported in accordance with the applicable reporting requirements, on the basis that completion is assessed on livelihood restoration rather than on payment having been made.

Raising a concern

Employees, suppliers, communities and any other party may raise a concern through the confidential reporting channels. We provide for anonymous reporting, and we do not tolerate retaliation against a person who raises a concern in good faith.
